A recent decision in favor of Gap Inc. against a non-practicing entity called Alexsam Inc. is a good example of kind of predatory misuse of the law these companies embody. The alleged patent troll company sued the ubiquitous clothing retailer for the methods by which it was adding funds to gift cards and then subtracting it at the point of sale later on, saying they constituted infringement. Adding to the difficulty for the Gap, gift cards are heavily regulated by the government to protect against money laundering and other malfeasance, so a change in the basic systems needed to use the cards could be extremely expensive. A jury found in favor of the Gap, but a number of similar cases are pending involving some of the nation's largest retailers. In one instance, Best Buy chose to settle out of court for an unknown sum of money.
