HSINCHU, Jan. 23, 2014 /PRNewswire/ -- Macronix International Co., Ltd. (TSE: 2337), a global leader providing non-volatile memory semiconductor solutions, through counsel today demanded that Spansion, Inc. cease and desist from making false, deceptive, and/or misleading statements concerning Macronix -- including Spansion's press releases and unsupported remarks of its senior executives. Macronix will hold Spansion and those executives accountable for such misconduct.
Macronix has received reports that Spansion and its senior executives are making false, deceptive, and/or misleading statements regarding Macronix, its products and business operations, and the on-going patent litigations between Macronix and Spansion.
Currently, Macronix has a seven-patent infringement litigation pending against Spansion in the United States District Court of Virginia. Macronix also has a three-patent complaint at the U.S. International Trade Commission (ITC) seeking to exclude Spansion non-volatile memory products from the United States. And Macronix has actions at the U.S. Patent Office to invalidate Spansion's patents asserted in another ITC case. Macronix remains confident in those actions even though Spansion argues it does not infringe any valid Macronix patents and Spansion argues that its patents are valid -- those issues will be decided by the judges.
As always, Macronix respects the rights of others and will enforce its rights against companies that infringe Macronix intellectual property rights, defame its reputation, and/or unlawfully interfere with its business relationship with others. Macronix will not tolerate whisper campaign of false and misleading statements concerning Macronix, its products, or its litigations against Spansion.
