Macronix Demands Spansion Cease and Desist False and Misleading Statements Concerning Macronix

HSINCHU, Jan. 23, 2014 /PRNewswire/ -- Macronix International Co., Ltd. (TSE: 2337), a global leader providing non-volatile memory semiconductor solutions, through counsel today demanded that Spansion, Inc. cease and desist from making false, deceptive, and/or misleading statements concerning Macronix -- including Spansion's press releases and unsupported remarks of its senior executives.  Macronix will hold Spansion and those executives accountable for such misconduct.

Macronix has received reports that Spansion and its senior executives are making false, deceptive, and/or misleading statements regarding Macronix, its products and business operations, and the on-going patent litigations between Macronix and Spansion.

Currently, Macronix has a seven-patent infringement litigation pending against Spansion in the United States District Court of Virginia.  Macronix also has a three-patent complaint at the U.S. International Trade Commission (ITC) seeking to exclude Spansion non-volatile memory products from the United States.  And Macronix has actions at the U.S. Patent Office to invalidate Spansion's patents asserted in another ITC case.  Macronix remains confident in those actions even though Spansion argues it does not infringe any valid Macronix patents and Spansion argues that its patents are valid -- those issues will be decided by the judges.

As always, Macronix respects the rights of others and will enforce its rights against companies that infringe Macronix intellectual property rights, defame its reputation, and/or unlawfully interfere with its business relationship with others.  Macronix will not tolerate whisper campaign of false and misleading statements concerning Macronix, its products, or its litigations against Spansion.

Macronix was first founded in Silicon Valley in the United States in 1984 and then headquartered in Taiwan in 1989 to research, develop, and manufacture state of the art non-volatile memory devices. The Company now operates three semiconductor fabs to manufacture its own brand of memory products, and its advanced technical papers have been continuously selected by international important meetings such as IEDM, ISSCC. Macronix is well recognized as a leading company that delivers high-quality, innovative and performance driven products to its customers in the consumer, communication, computing, automotive, networking, and other market segments.

Macronix has invested heavily nearly 10-15% of its annual revenue in the research and development of non-volatile memory technology in recent years.  As a result of those investments, Macronix has been granted with more than 5,000 patents world-wide and over 2,000 in the United States. In addition, Macronix was ranked 18th worldwide, and first in Taiwan for its total patent strength in the semiconductor industry in a 2011 analysis conducted by The Patent Board.
