Texas Judge Rules in Favor of GM Recall Victims represented by Thomas J. Henry Injury Attorneys

GM Ordered to Turn over all Records to Thomas J. Henry Injury Attorneys' Clients

CORPUS CHRISTI, Texas, March 19, 2014 /PRNewswire/ -- In a victory for victims severely injured by GM vehicles with defective ignitions, a Texas judge has ordered General Motors to turn over all records pertaining to the defective vehicles by March 24, 2014.

Thomas J. Henry Injury Attorneys is representing a number of individuals who were injured in/by vehicles recently recalled by General Motors. The firm is also representing the families of individuals who died in accidents involving the recalled vehicles.

The following requests were made by plaintiffs in a Temporary Retraining Order filed on March 17, 2014:

Plaintiffs request that the Court grant their request for an expedited discovery process and require Defendants to produce their response to the specific discovery requests on or before March 24, 2014. Specifically, Plaintiffs request that GM be ordered to produce all documents exchanged in state court litigation concerning ignition switch failure and/or product recall.

  • Par. 54. Application for Temporary Restraining Order

The judge granted the plaintiff's request – as outlined in the signed order (below):

It is further ordered that Defendant comply with the discovery request set out in section 7 of Plaintiffs' First Amended Original Petition found in paragraphs 54, 55, and 56.

  • Excerpt from Temporary Restraining Order and Order Setting Hearing for Temporary Injunction, signed by Judge Klager on March 17, 2014, Nueces County Court at Law No. 4

The requested records will help determine what and when GM knew about defects in the recalled vehicles. The National Highway Traffic Safety Administration made a similar request for records back on March 5 – giving GM a response deadline of April 3, 2014.

Due to the swift and aggressive move by lead attorney Thomas J. Henry, accident victims may have access to many of the records already requested by the government.

"This is about protecting the public," Thomas J. Henry stated, after securing the court order. "Every day, GM recalls more and more vehicles, unveiling how they jeopardized people's safety and lives. We can't just stand around knowing people have been seriously injured or have died as a result of these vehicles. The victims and the public deserve to know how dangerous these vehicles are and have the right to know whether or not they are safe to drive at all. GM needs to turn over these documents, all documents related to these vehicles, immediately."

"My law firm has taken numerous calls from families from across the country looking for answers. Families who lost loved ones back in 2004, 2005, 2006… in accidents with vehicles affected by the recall. These families never got answers from GM, now they are looking to me. We will have more answers when this court order is complied with."

GM recalled 1.6 million vehicles in February due to defective ignition switches which cause vehicles to shut off and prevent airbags from deploying. Recalled vehicles include the 2005-2007 Chevrolet Cobalt, 2007 Pontiac G5, 2003-2007 Saturn Ion, 2006-2007 Chevrolet HHR, 2006-2007 Pontiac Solstice, 2006-2007 Saturn Sky.

The Temporary Restraining Order and Order Setting Hearing for Temporary Injunction was filed in Nueces County Court at Law No. 4 on March 17, 2014. Cause No. 2014CCV-60443-4.

Technology vendors and analysts are eager to paint a rosy picture of how wonderful IoT is and why your deployment will be great with the use of their products and services. While it is easy to showcase successful IoT solutions, identifying IoT systems that missed the mark or failed can often provide more in the way of key lessons learned. In his session at @ThingsExpo, Peter Vanderminden, Principal Industry Analyst for IoT & Digital Supply Chain to Flatiron Strategies, will focus on how IoT de...
In his session at @ThingsExpo, Kausik Sridharabalan, founder and CTO of Pulzze Systems, Inc., will focus on key challenges in building an Internet of Things solution infrastructure. He will shed light on efficient ways of defining interactions within IoT solutions, leading to cost and time reduction. He will also introduce ways to handle data and how one can develop IoT solutions that are lean, flexible and configurable, thus making IoT infrastructure agile and scalable.
Complete Internet of Things (IoT) embedded device security is not just about the device but involves the entire product’s identity, data and control integrity, and services traversing the cloud. A device can no longer be looked at as an island; it is a part of a system. In fact, given the cross-domain interactions enabled by IoT it could be a part of many systems. Also, depending on where the device is deployed, for example, in the office building versus a factory floor or oil field, security ha...
"We have several customers now running private clouds. They're not as large as they should be but it's getting there. The adoption challenge has been pretty simple. Look at the world today of virtualization vs cloud," stated Nara Rajagopalan, CEO of Accelerite, in this SYS-CON.tv interview at 18th Cloud Expo, held June 7-9, 2016, at the Javits Center in New York City, NY.
An IoT product’s log files speak volumes about what’s happening with your products in the field, pinpointing current and potential issues, and enabling you to predict failures and save millions of dollars in inventory. But until recently, no one knew how to listen. There are several IoTs: the Industrial Internet, Consumer Wearables, Wearables and Healthcare, Supply Chains, and the movement toward Smart Grids, Cities, Regions, and Nations. There are competing communications standards every step of the way, a bewildering array of sensors and devices, and an entire world of competing data analytics platforms. To some this appears to be chaos. In this power panel at @ThingsExpo, moderated by Conference Chair Roger Strukhoff, Bradley Holt, Developer Advocate a...
Fifty billion connected devices and still no winning protocols standards. HTTP, WebSockets, MQTT, and CoAP seem to be leading in the IoT protocol race at the moment but many more protocols are getting introduced on a regular basis. Each protocol has its pros and cons depending on the nature of the communications. Does there really need to be only one protocol to rule them all? Of course not. In his session at @ThingsExpo, Chris Matthieu, co-founder and CTO of Octoblu, walk you through how Oct...

The Jevons Paradox suggests that when technological advances increase efficiency of a resource, it results in an overall increase in consumption. Writing on the increased use of coal as a result of technological improvements, 19th-century economist William Stanley Jevons found that these improvements led to the development of new ways to utilize coal. In his session at 19th Cloud Expo, Mark Thiele, Chief Strategy Officer for Apcera, will compare the Jevons Paradox to modern-day enterprise IT, e...
