Cotman IP Law Wins Three-Year Legal Battle to Stop Counterfeit Sales of Original Michel Work Boot Brand

LOS ANGELES, CA -- (Marketwired) -- 05/05/14 -- Pasadena Intellectual Property Attorney Dan Cotman today announced an important ruling by the Honorable Judge Cristina Snyder of the U.S. District Court for the Central District of California. Judge Snyder recently issued a permanent injunction prohibiting infringers Reynaldo Hernandez and his employer, Zapateria Diana, from selling counterfeit ORIGINAL MICHEL brand work boots to stores across America. This is a victory for the owner of Los Altos Boots, Rodolfo Avila-Sandoval, who has been battling Zapateria Diana's aggressive sale of counterfeit goods in the marketplace for over three years.

Dan Cotman, founder of Cotman IP Law Group and lead counsel for Los Altos Boots, stated, "I am pleased we were able to stop this distributor of counterfeit goods from reaping any financial benefit resulting from having knocked-off our client's ORIGINAL MICHEL brand work boots. The ORIGINAL MICHEL brand work boots are very popular in the Hispanic marketplace and have been sold in the United States since 1983. The brand originated from a family business started in Mexico in 1970 by the Retamoza family. In 1983, Mario Cervantes Retamoza began distributing ORIGINAL MICHEL work boots to distributors in the United States, further establishing the brand. In 2011, Mr. Rodolfo Avila-Sandoval then purchased the brand and continued building on the longstanding goodwill and business legacy of the ORIGINAL MICHEL brand created by the Retamoza family. In doing so, he encountered counterfeit ORIGINAL MICHEL goods in the marketplace, which were being sold by Reynaldo Hernandez, an employee of Zapateria Diana, who at one point purchased authentic ORIGINAL MICHEL work boots from the Retamoza family but opted, later, to purchase counterfeit boots to save on costs.

Rasheed McWilliams, the attorney with Cotman IP who argued the Motion for Summary Judgment filed on behalf of the Defendants says, "I'm glad to have been able to completely turn the tables against the plaintiff, who filed this frivolous lawsuit against our clients seeking to intimidate them into a settlement.
