PHILADELPHIA, PA -- (Marketwired) -- 08/08/14 -- The Anapol Schwartz personal injury law firm is now accepting cases involving Johnson & Johnson (J&J) Ethicon morcellators, which pose the risk of spreading undetected malignant uterine sarcoma into a woman's body during a hysterectomy or myomectomy. Women and their families are urged to contact the firm immediately to protect their legal rights and discuss filing a morcellator cancer lawsuit.
Johnson & Johnson issued an Ethicon morcellator recall on July 30 -- three months after the company suspended sales of the device in response to a morcellation cancer warning issued by the U.S. Food and Drug Administration. A July 22 study published in the Journal of the American Medical Association found that 27 per 10,000 women had undetected uterine cancer while undergoing a minimally invasive hysterectomy using power morcellation.*
When the morcellator cuts uterine tissue into fragments for removal, it can simultaneously blast the cancerous cells into a woman's abdomen and pelvis and significantly worsen her likelihood of survival.** A May 30 article in the Pittsburgh Business Times reported a physician had warned J&J in 2006 of exactly this type of outcome.***
"Patients must be adequately warned about the possible risks associated with surgical devices so they may adequately weigh the health benefits and risks," said Anapol Schwartz Shareholder Thomas Anapol. "But when manufacturers fail to warn them, they can be put at risk for dangerous complications, which in this case could mean the spread of life-threatening cancer."
Anapol is Co-Chair of the firm's Mass Tort Department and serves in various leadership capacities in national medical device litigation.
