New Lawsuit would Aid Those Not Covered by GM Victim Compensation Fund

The automaker claims that they are not liable for damages because the crashes occurred before their bankruptcy in 2009.

Meanwhile, some clients cited in the lawsuit were in vehicles that were tied to the 54 crashes and 13 deaths acknowledged by the automaker, yet still don't meet the criteria for compensation. For example, collision victims in cars whose air bags inflated in a crash are not currently eligible, while others were in different GM vehicles that have since been recalled for ignition switch issues.
